Employment Law

    The firm's employment law practice includes the representation of employers in employment discrimination litigation matters, defending against claims of race, age, disability and gender discrimination, as well as against claims of retaliation. Sharon Erwin has appeared before the Equal Employment Opportunity Commission, the Pennsylvania Human Relations Commission; the Massachusetts Commission Against Discrimination; and the New Jersey Division of Civil Rights. Sharon has also defended against litigation brought by the Equal Employment Opportunity Commission.

    Sharon's employment law practice also involves counseling and advice in connection with various employment and human resource issues, including the investigation of sexual harassment allegations, workplace violence issues, the drafting and enforcement of restrictive covenants, and the drafting and review of employee manuals, severance agreements and consulting services contracts. Her practice also includes the representation of internet service and content providers on employment-related matters.

Litigation

    Sharon Erwin is primarily responsible for all litigation matters handled by the firm. Through her training and experience in a large law firm and then a small firm that grew to a mid-sized firm by the mid-1990's, Sharon developed a broad-based, varied trial and litigation management practice with an emphasis in employment litigation, information technology litigation, aviation-related litigation, as well as alternative dispute resolution. Her practice also includes insurance coverage litigation, arts-related law and commercial litigation.

    Sharon's federal and state jury and non-jury trial experience includes litigation in the United States District Court for the Eastern and Middle Districts of Pennsylvania, and the District of New Jersey; the Courts of Common Pleas of Philadelphia, Montgomery, Chester, Delaware, Bucks, Dauphin and Lackawanna Counties of the Commonwealth of Pennsylvania; as well as appearances pro hac vice in other jurisdictions such as the New Jersey Superior Court and the California Superior Court of Alameda County.

    Federal and state appellate experience includes briefing and arguments before the Third Circuit Court of Appeals, the Pennsylvania Supreme, Superior and Commonwealth Courts, and California and Michigan appellate courts. Sharon's practice in the area of Alternative Dispute Resolution includes experience before the American Arbitration Association, and federal and state arbitration and mediation programs.

Information Technology

    The firm's practice in this area includes litigation and the resolution of information technology disputes through alternative dispute resolution, primarily disputes involving systems acquisitions and problem installations, and counseling and contract negotiations in connection with web development agreements and online privacy policies.

    Sharon is an active member of the e-Health and Privacy Interest Group of the Health Law Section of The American Bar Association, and is a member of the Editorial Board of The Health Lawyer as the liaison from the e-Health and Privacy Interest Group.

Art Law

    Sharon's arts-related practice evolved naturally from her longstanding support of the arts and her experience as a weekend painter. Her practice in this area includes the representation of cultural non-profits, ranging from arts to theater organizations, as well as individual artists, film makers, musicians, and gallery owners. Her practice ranges from copyright and insurance advice and litigation, to contract and employment-related counseling and dispute resolution, to issues of public art, preservation, and web site development.

    The commitment to pro bono service to the arts community has led to many interesting and rewarding representations, including most recently the representation of the nation's first and oldest public art organization, the Fairmount Park Art Association, in the administrative and legal proceedings surrounding the preservation of the Maxfield Parrish/Louis Comfort Tiffany glass mosaic masterpiece, The Dream Garden.

Community Service

    Sharon's commitment to community service is reflected in her service as a long-standing member and past officer of the Philadelphia Volunteer Lawyers for the Arts and in her pro bono representation of cultural non-profits and individual artists, musicians, film makers and gallery owners. She has served in the past as a Member and past Chair of the Board of Directors of InterAct Theatre Company, and currently serves on the Board of the Independence Hall Association. Sharon also serves on the leadership committee to the Wilma Theater's annual gala to raise funds for artistic initiatives.

    Sharon has also served as a Settlement Master and Judge Pro Tempore for the Philadelphia Court of Common Pleas.
